Garage Sale Vintage Online Seller Agreement

Effective: June 1, 2025

Welcome to the Garage Sale Vintage (GSV) Online Marketplace. We’re excited to support passionate vintage vendors. By submitting your application and using the GSV marketplace, you agree to the terms of this Seller Agreement in full. Please read carefully.

1. Vendor Eligibility & Registration

To be eligible to sell on the GSV online marketplace, vendors must:

  • Offer authentic vintage clothing and accessories, generally 18+ years old (i.e., made in 2006 or earlier).

  • Sell only high-quality, well-maintained items that reflect GSV's brand standards.

  • Have access to a computer and camera or smartphone for uploading accurate listings.

  • Commit to timely and professional order fulfillment and communication.

Prohibited Listings Include:

  • Clothing manufactured after 2010

  • Fast fashion or mass-market labels (e.g., Shein, H&M, Zara, Forever 21)

  • Counterfeit, replica, stolen, or trademark-infringing items

  • Items that promote hate speech, discriminatory content, or violate local laws

GSV retains sole discretion to approve or reject any application or listing.

2. Commission, Fees & Payouts

  • Seller of Record: Vendors remain the seller of record for all products sold on the GSV platform. Vendors are solely responsible for tax reporting, remittance, and legal compliance.

  • Commission Structure:

    • Founding Vendors pay a 15% commission until January 1, 2026.

    • Starting January 1, 2026, the commission rate increases to 18%, with a $15/month membership fee.

  • Commission is based on the product sale price (excluding tax and shipping).

  • Payouts: Issued monthly by the 15th of the following month. GSV may withhold payouts in cases of policy violations, chargebacks, suspected fraud, or unresolved disputes.

  • Policy Changes: GSV reserves the right to update commission rates, membership fees, payout schedules, and other related terms at its sole discretion. Vendors will be notified of any such changes via email or through the vendor dashboard. Continued use of the platform after notification constitutes acceptance of the updated terms.

3. Product Listings

Listing Requirements:

  • Minimum of 3 clear, well-lit photos on a white or neutral background

  • Include multiple angles, including detail shots of any flaws

  • Required fields:

    • Descriptive title (e.g., “Levi’s Denim Jacket – Distressed – 1990s”)

    • Era, material, condition, accurate measurements

    • Sizing + fit notes

    • Condition tag (see below)

    • Any known flaws or alterations

Condition Tags:

  • Excellent: Near-new vintage condition, no visible flaws

  • Very Good: Minor wear, no major flaws

  • Good: Visible wear or flaws, still wearable

  • Fair/Distressed: Heavy wear or damage, best for styling/costume

All listings must be accurate and truthful. GSV reserves the right to remove any listings that do not meet marketplace standards.

4. Pricing & Promotions

  • Vendors must price items fairly and competitively.

  • GSV may request price changes for consistency across the marketplace.

  • Vendors agree to participate in sitewide promotions or seasonal sales initiated by GSV.

  • Additional promotional tools (e.g., discount codes) may be available to upgraded vendor accounts.

5. Order Fulfillment & Shipping

  • Orders must be shipped within 3 business days, and no later than the next Monday or Thursday, whichever comes first.

  • Vendors must use trusted carriers: USPS, UPS, or FedEx. Drop-shipping is prohibited.

  • Tracking numbers must be uploaded to the vendor dashboard immediately after shipment.

  • Vendors are responsible for secure and professional packaging.

Shipping Liability: GSV is not liable for lost, stolen, or delayed shipments. Vendors assume all shipping risk.

6. Customer Service, Returns & Disputes

Customer Service:

  • Vendors must respond to buyer inquiries within 48 hours.

Returns & Refunds:

  • GSV encourages vendors to offer a “Final Sale” policy unless items are damaged or misrepresented.

  • If a return is accepted, the vendor must:

    • Clearly state the return window (e.g., 7–14 days)

    • Clarify who pays for return shipping

    • Provide a return label (if applicable)

    • Issue a full refund upon return receipt

Disputes: GSV may help mediate disputes, but ultimate resolution is the vendor’s responsibility.

7. Privacy & Data Protection

  • Vendors must treat customer information as strictly confidential.

  • Vendors may only use customer data to fulfill orders and must not share or use it for marketing, resale, or any unauthorized purpose.

  • Vendors must comply with all applicable privacy laws (e.g., CCPA, GDPR).

8. Code of Conduct & Anti-Harassment Policy

GSV is committed to maintaining a respectful and safe marketplace.

Prohibited Conduct Includes:

  • Harassment, bullying, discrimination, or hate speech

  • Hostile, unprofessional, or inappropriate communication with customers, vendors, or GSV staff

Violations will result in immediate suspension or permanent removal from the marketplace.

9. Intellectual Property & Content Use

  • Vendors retain ownership of their original product photos and descriptions.

  • By listing on GSV, vendors grant GSV a non-exclusive, royalty-free license to use their listing content in marketing, social media, or promotional campaigns.

  • Vendors may not use GSV branding, logos, or marks without prior written consent.

10. Indemnification

Vendors agree to indemnify, defend, and hold harmless GSV and its affiliates against any claims, damages, or losses arising from:

  • Misrepresentation of products

  • Violation of laws or platform policies

  • Customer or third-party disputes

  • Use of copyrighted or trademarked materials without authorization

11. Termination

  • Vendors may close their shop at any time but must fulfill all open orders.

  • GSV reserves the right to terminate any vendor account at any time, with or without cause.

  • Grounds for immediate termination include:

    • Repeated policy violations

    • Fraud or misconduct

    • Harassment

    • Poor communication or fulfillment record

    • Behavior or activity that harms the GSV brand

12. Agreement Updates & Legal Jurisdiction

  • GSV may update this Agreement at any time. Vendors will be notified via email or the vendor dashboard.

  • Continued use of the platform implies acceptance of updated terms.

  • This Agreement is governed by the laws of the State of Colorado.

  • Any disputes will first attempt resolution via informal mediation. If necessary, legal proceedings will take place in the state or federal courts of Colorado.

Agreement Confirmation

By submitting your vendor application, you acknowledge that you have read, understood, and agreed to comply with this Seller Agreement in full.
